US Tax Guide for App Developers

Everything mobile app developers and publishers need to know about US tax obligations, required forms, deductions, and compliance when operating a US LLC as a non-resident.

Overview: App Developers with a US LLC

A US LLC is required to publish on Apple App Store and Google Play Store under a business developer account. It provides liability protection for app-related issues, access to US ad networks, and credibility with potential acquirers.

Best Business Structure

For app developers, we recommend: Single-Member LLC (Disregarded Entity)

A US LLC is required to publish on Apple App Store and Google Play Store under a business developer account. It provides liability protection for app-related issues, access to US ad networks, and credibility with potential acquirers.

Tax Considerations for App Developers

App Store and Google Play revenue is generally classified as royalty income for tax purposes. Apple and Google withhold 30% on payments to foreign developers without a valid W-8BEN. In-app purchases, subscriptions, and app sale revenue all follow similar rules. Ad revenue (from AdMob, etc.) may be classified differently.

Important Note for App Developers

Apple withholds US tax on App Store proceeds paid to non-US developers. Without a W-8BEN, Apple withholds 30% of all US-sourced revenue. With proper treaty benefits, this can often be reduced to 0-10%. Note that Apple only withholds on US-sourced revenue (sales to US customers), not worldwide revenue. Google Play has similar withholding requirements. Submit your W-8BEN through Apple's App Store Connect and Google's Play Console tax settings.

Required Tax Forms

As a non-resident app developer with a US LLC, you'll typically need these forms:

  • Form 5472 + Pro Forma 1120 (required annually)
  • Form W-8BEN (for Apple, Google, and ad networks)
  • Form 1042-S (from platforms that withheld tax)
  • Form 1040-NR (to claim refund or report income)
  • Form W-7 (ITIN application)

Key Filing Deadline

Form 5472 + Pro Forma 1120: Due April 15 (extension available to October 15). Penalty for non-filing: $25,000. This applies even if your LLC had zero income.

Common Deductions for App Developers

These business expenses are typically deductible for app developers operating through a US LLC:

  • Apple Developer Program fee ($99/year)
  • Google Play Developer fee ($25 one-time)
  • Development tools and software
  • Cloud backend services (Firebase, AWS)
  • App testing devices and services
  • UI/UX design services
  • App Store Optimization (ASO) tools
  • Push notification and analytics services
  • Customer support tools

Tips for Tax Compliance

  1. Register developer accounts under your LLC name
  2. Submit W-8BEN to Apple and Google immediately
  3. Track revenue by platform and country
  4. Understand that Apple/Google withhold 30% without W-8BEN
  5. Consider whether in-app ads vs purchases have different tax treatment
  6. Keep records of development costs for potential R&D credits
